Terms of Service for Recruitment Services

Preamble

The following Terms of Service apply to all recruitment services of Talent Bridge SAS (hereinafter "Talent Bridge" or "we") towards applicants and employers.

Talent Bridge operates as a recruitment agency and brings employers and job seekers together. The placement is carried out in accordance with applicable employment and civil law regulations.

§ 1 Scope

(1) These Terms of Service apply to all contracts between Talent Bridge and

  • Job seekers (hereinafter "Applicants")
  • Companies seeking personnel (hereinafter "Clients" or "Employers")

(2) Deviating conditions of the client or applicant will not be recognized unless Talent Bridge expressly agrees to their validity in writing.

(3) These Terms of Service also apply to all future business relationships, even if they are not expressly agreed upon again.

§ 2 Services for Applicants

(1) Free of charge: The placement services of Talent Bridge are completely free of charge for applicants. There are no fees or other costs.

(2) Placement service: Talent Bridge endeavors to find a suitable position for the applicant. There is no entitlement to successful placement.

(3) Consultation: Talent Bridge offers free career counseling and support with applications.

(4) Confidentiality: All applicant data is treated confidentially and only passed on to potential employers with explicit consent.

(5) Obligations of the applicant:

  • Provide complete and truthful information
  • Notify changes to personal data immediately
  • Inform Talent Bridge about job offers
  • Adhere to agreed appointments

§ 3 Services for Clients

(1) Placement: Talent Bridge places suitable applicants for open positions of the client.

(2) Pre-selection: Talent Bridge conducts a pre-selection of candidates and presents only suitable applicants.

(3) Consultation: Talent Bridge advises the client on job descriptions and candidate selection.

(4) Replacement placement: In case of dropout of a placed employee within the probationary period, Talent Bridge offers a free replacement placement where possible.

§ 4 Contract Formation

(1) The placement contract between Talent Bridge and the client is concluded through written order placement.

(2) The contract with applicants is concluded through registration or submission of application documents.

(3) Talent Bridge is entitled to reject orders without giving reasons.

§ 5 Compensation

(1) For Applicants: Placement is always free for applicants.

(2) For Clients: Compensation for placement services to clients is agreed upon in separate contracts.

(3) Due date: The placement fee becomes due after successful placement and commencement of work by the candidate.

(4) Successful placement: A placement is considered successful when an employment contract is concluded between the client and the applicant presented by Talent Bridge.

§ 6 Data Protection

(1) Talent Bridge commits to processing all personal data in accordance with the General Data Protection Regulation (GDPR) and applicable national data protection laws.

(2) Applicant data is only passed on to third parties with explicit consent.

(3) Detailed information can be found in our Privacy Policy.

§ 7 Cooperation Obligations

(1) Applicants commit to:

  • Providing complete and accurate information
  • Informing Talent Bridge of relevant changes
  • Participating in agreed interviews
  • Reporting job offers immediately

(2) Clients commit to:

  • Providing complete job descriptions
  • Giving timely feedback
  • Informing Talent Bridge about hirings
  • Treating applicant data confidentially

§ 8 Liability

(1) Talent Bridge is unlimitedly liable for intent and gross negligence.

(2) In case of slight negligence, Talent Bridge is only liable for breach of essential contractual obligations (cardinal obligations).

(3) Talent Bridge assumes no liability for the accuracy of information provided by applicants.

(4) Liability for data loss is limited to the typical recovery effort that would have been incurred with regular and risk-appropriate creation of backup copies.

§ 9 Contract Term and Termination

(1) Applicants: The contract with applicants can be terminated by either party at any time without giving reasons.

(2) Clients: The contract term with clients is individually agreed upon.

(3) The right to extraordinary termination for good cause remains unaffected.

(4) Terminations require written form or text form (email).

§ 10 Final Provisions

(1) Jurisdiction: The place of jurisdiction is Paris, provided that the contractual partner is a merchant, a legal entity under public law, or a special fund under public law.

(2) Applicable law: French law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

(3) Severability clause: Should individual provisions of these Terms of Service be or become invalid, the validity of the remaining provisions remains unaffected.

(4) Amendments: Amendments and additions to these Terms of Service require written form. This also applies to the waiver of this written form requirement.
